These Terms & Conditions govern your use of the Love My Artist website and all purchases made through www.lovemyartistdesigns.com.

By accessing this website, creating an account, or completing a purchase, you agree to these Terms & Conditions and any additional policies referenced herein, including our Privacy Policy, Shipping, Returns & Happiness Guarantee, Digital Product Policy, and Custom & Commissioned Work Policy.

1. ABOUT LOVE MY ARTIST

Love My Artist is an independent creative business offering original artwork, greeting cards, fine art prints, including ACEO mini prints and various print sizes, handmade ornaments, custom-designed apparel and footwear, including Italian-crafted purses, backpacks, and shoes, digital products, custom videos, and commissioned creative works.

Products, services, and website inventory may change or be updated at any time without prior notice.

2. ORDERS, PRICING & PAYMENTS

Accuracy: By placing an order, you agree that all information provided, including contact, billing, and shipping details, is accurate, complete, and current.
Pricing & Taxes: Prices are listed on the website and are subject to change without notice. Applicable state and local sales taxes and shipping charges are displayed prior to final payment. Buyers are responsible for any applicable import duties, VAT, customs fees, or other charges associated with international deliveries.
Order Acceptance: Submitting an order does not constitute final acceptance. Love My Artist reserves the right to refuse or cancel an order due to pricing errors, product unavailability, payment processing issues, suspected fraud, or other reasonable business circumstances. If an order is canceled after payment has been received, a refund will be issued to the original payment method.

3. MINORS & AUTHORIZED PAYMENT METHODS

By placing an order through Love My Artist, you represent that you are at least 18 years old or are making the purchase with the knowledge and permission of a parent or legal guardian.

You also represent that you are authorized to use the payment method provided at checkout. Love My Artist is not responsible for purchases made using a credit card, debit card, PayPal account, or other payment method without the account holder’s permission.

If you believe a purchase was made using your payment method without authorization, please contact Love My Artist as soon as possible so we can review the order and, when possible, stop processing or shipment. Unauthorized transactions may also be subject to the policies and dispute procedures of the applicable bank, card issuer, payment processor, or payment platform.

4. DIGITAL PRODUCTS & PERSONAL USE LICENSE

Grant of License: When you purchase a digital product, including downloadable artwork, digital files, or custom video files, Love My Artist grants you a non-exclusive, non-transferable, single-user license for personal, non-commercial use only.
Restrictions: You may not redistribute, share, host, upload, sublicense, resell, alter for resale, or commercially exploit any digital files or artwork without prior written consent from Love My Artist.

5. CUSTOM, COMMISSIONED WORK & THIRD-PARTY IP COMPLIANCE

Deposits & Finality: Custom and commissioned orders, including personalized videos, custom artwork, and bespoke items, require full payment or a non-refundable deposit as specified at the time of order. Once production or design work has begun on a custom project, the order cannot be canceled, refunded, or returned.
Third-Party Copyrights & Trademarks: Love My Artist respects intellectual property laws and will not knowingly reproduce or incorporate protected characters, logos, trademarks, copyrighted media, or other third-party intellectual property into custom work without appropriate permission.
Customer-Provided Materials & Indemnification: You represent and warrant that you own or have the necessary rights and permissions to use any photographs, images, audio, text, video, or other materials you submit for a custom order. You agree to defend, indemnify, and hold harmless Love My Artist from claims, liabilities, costs, or legal fees arising from third-party copyright, trademark, privacy, or publicity claims related to materials you provide.
Love My Artist reserves the right to refuse any custom request that may violate intellectual property laws or otherwise contains content Love My Artist determines is inappropriate.

6. INTELLECTUAL PROPERTY & ORIGINAL DESIGNS

Original artwork, illustrations, graphics, photographs, video content, written copy, branding, logos, and original creative designs created by Love My Artist remain the intellectual property of Love My Artist and are protected by applicable United States and international intellectual property laws.

No Unauthorized Reproduction: You may not photograph, scan, screenshot, copy, reproduce, distribute, license, alter, or create derivative works from Love My Artist artwork or products for resale, commercial use, or unauthorized distribution.
No Transfer of Copyright: Purchasing an original artwork, print, greeting card, ornament, digital product, custom creation, or other physical product does not transfer copyright, reproduction rights, or intellectual property ownership to the buyer unless expressly agreed to in writing.

7. PRODUCT DESCRIPTIONS, HANDMADE VARIATIONS & PRINT COLORS

Color Accuracy: Every effort is made to represent artwork and products accurately. However, colors may vary slightly between what appears on a device screen and the final product because of differences in monitors, device settings, printing methods, materials, and substrates.
Handmade & Artisanal Products: Minor variations in size, texture, color, placement, or finish may occur in original artwork, handmade items, and certain custom products. These variations are part of the character of handmade and individually produced items.
Production Partners: All Love My Artist artwork and creative designs originate with Love My Artist. Certain products may be professionally reproduced, manufactured, printed, or fulfilled by third-party production partners in order to offer the artwork in different formats and materials.

8. SHIPPING, DELIVERY & LOST OR STOLEN PACKAGES

Addresses & P.O. Boxes: Customers are responsible for providing complete and accurate delivery information. Shipping to secure P.O. Boxes is permitted where supported by the applicable carrier.
Carrier Transfer & Delivery: Orders may be shipped through USPS or other designated carriers. Delivery dates and transit times are estimates and cannot be guaranteed.
Stolen or Missing Packages: Love My Artist is not responsible for packages marked “Delivered” by the shipping carrier that are subsequently stolen, lost, or misplaced after delivery.
Carrier Claims & Optional Insurance: Love My Artist is not responsible for filing claims on behalf of buyers for packages stolen after confirmed delivery. If optional shipping insurance is offered, customers purchasing higher-value products are encouraged to consider it.

9. RETURNS, REFUNDS & EXCHANGES

Physical Goods: Eligible standard physical products are governed by our Shipping, Returns & Happiness Guarantee.
Final Sale Items: Digital downloads, custom and commissioned projects, custom videos, personalized goods, and other made-to-order products may be non-refundable and non-returnable as described in the applicable product and policy terms.
Order Cancellations: Standard in-stock orders may be canceled within 1 hour of placement, provided the order has not already been processed or shipped.

10. ASSUMPTION OF RISK, DISCLAIMERS & LIMITATION OF LIABILITY

Assumption of Risk: By purchasing and using physical products from Love My Artist, including footwear, apparel, accessories, ornaments, and artwork, you acknowledge that products should be used as intended. You assume risks associated with improper use, handling, wear, or misuse of a product.
Third-Party Manufacturers: Certain products, including custom footwear, accessories, canvas products, prints, and other merchandise, may be produced by third-party production or fulfillment partners. To the maximum extent permitted by applicable law, Love My Artist disclaims implied warranties except where such warranties cannot legally be excluded.
Limitation of Liability: To the fullest extent permitted by applicable law, Love My Artist, its owner, and affiliates shall not be liable for indirect, incidental, punitive, special, or consequential damages arising from use of the website or products.
Monetary Cap: To the fullest extent permitted by law, Love My Artist's total cumulative liability relating to a product claim shall not exceed the amount actually paid by the customer for the specific product giving rise to the claim.

11. MANDATORY ARBITRATION & CLASS ACTION WAIVER

Binding Individual Arbitration: You and Love My Artist agree that disputes, claims, or controversies arising from these Terms, the website, or products purchased shall be resolved through final and binding individual arbitration in the State of Colorado rather than in court, except where a qualifying claim may be brought in small claims court or where applicable law provides otherwise.
Class Action Waiver: TO THE EXTENT PERMITTED BY LAW, YOU AND LOVE MY ARTIST AGREE THAT CLAIMS AGAINST THE OTHER WILL BE BROUGHT ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN A PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

12. AFFILIATE LINKS

Love My Artist may occasionally provide links to products, services, retailers, or other third-party websites. Some of these links may be affiliate links, which means Love My Artist may receive a small commission if you make a qualifying purchase through the link, at no additional cost to you.

Affiliate relationships do not increase the price you pay. Products, services, purchases, shipping, returns, warranties, and customer service provided by third-party retailers are governed by that third party’s own terms and policies.

Where required, Love My Artist will provide appropriate disclosure when affiliate links are used.

13. EXTERNAL LINKS

The Love My Artist website may contain links to third-party websites, retailers, social media platforms, or other online services that are not owned or controlled by Love My Artist.

Love My Artist is not responsible for the content, availability, security, privacy practices, terms, products, or services of third-party websites. When you leave our website, your use of another website or service is governed by that third party’s own terms, policies, and privacy practices.

14. USER COMMUNICATIONS & SUBMISSIONS

When you contact Love My Artist or submit information through the website, including through contact forms, custom commission requests, email, reviews, or other communications, you agree not to submit unlawful, abusive, defamatory, threatening, fraudulent, infringing, or otherwise inappropriate content.

Materials submitted for custom or commissioned projects are handled in accordance with our Privacy Policy and Custom & Commissioned Work Policy.

You retain ownership of photographs, videos, text, audio, and other materials you provide, subject to the rights and permissions reasonably necessary for Love My Artist to review, create, produce, and deliver the project or service you requested.

By submitting materials for a custom project, you confirm that you own those materials or have permission from the appropriate rights holder to use them for the requested purpose.

15. ENTIRE AGREEMENT

These Terms & Conditions, together with any policies, product descriptions, custom project agreements, and other terms referenced on this website, constitute the entire agreement between you and Love My Artist concerning your use of this website and purchases made through it.

Any separate written agreement relating to a custom or commissioned project will also apply to that specific project.

16. SEVERABILITY

If any provision of these Terms & Conditions is determined to be invalid, unlawful, or unenforceable, that provision will be limited or removed only to the extent necessary, and the remaining provisions will continue in full force and effect.

17. GOVERNING LAW & VENUE

These Terms & Conditions are governed by the laws of the State of Colorado and applicable United States federal law, without regard to conflict-of-law principles.

Subject to the arbitration provisions above, any legal proceeding arising under these Terms shall be brought in an appropriate state or federal court located in Colorado, and the parties consent to the jurisdiction of those courts.

18. CHANGES TO THESE TERMS

Love My Artist reserves the right to update these Terms & Conditions periodically to reflect changes in business practices, product offerings, website functionality, or applicable requirements.

The current version and effective date will be posted on this website. Continued use of the website after updated Terms are posted constitutes acceptance of the revised Terms.
