Thank you for commissioning custom work from Love My Artist! We love creating bespoke pieces—including original fine artwork, personalized videos, custom digital images, and original lyrical songs.

Please review this policy before placing a custom or commissioned order. By submitting payment or a deposit for a custom order, you agree to the terms below.

 

1. ORIGINAL ARTWORK & PHYSICAL DELIVERABLES

• Original Physical Art: When you commission physical artwork (e.g., original oil pastel paintings, custom physical art pieces), you receive the physical original work created specifically for you.

• Handcrafted Unique Nature: Because every commissioned piece is individually handcrafted, minor variations, texture differences, and artistic characteristics are a natural part of the custom creative process.

 

2. PERSONAL USE LICENSE ONLY

All custom and commissioned creations—whether a physical original painting, custom video, digital artwork file, or custom lyrical song—are created for your personal, non-commercial use only.

• What You CAN Do: Display the physical art in your home or business, play the custom video/song for personal celebrations, share videos or audio on your personal (non-monetized) social media channels, or keep the original work as an heirloom.

• What You CANNOT Do: You may not resell, sub-license, reproduce, upload to commercial music/art streaming platforms, or use the commissioned artwork, song, audio, or video for commercial marketing, business monetization, or resold merchandise without explicit prior written permission from Love My Artist.

 

3. COPYRIGHT & REPRODUCTION RIGHTS (IMPORTANT)

In accordance with federal copyright law, Love My Artist retains full legal copyright and intellectual property rights to all original designs, custom artwork, digital images, song lyrics/compositions, and custom video concepts.

• No Transfer of Ownership: Receiving the physical original artwork, video file, or audio recording grants you ownership of the physical piece or digital deliverable and a personal use license; it does NOT transfer copyright or reproduction rights to you.

• Right to Reproduce & Print: Love My Artist explicitly reserves the right to capture high-resolution images or digital recordings of any custom work created and adapt, publish, or reproduce those designs into greeting cards, fine art prints, ACEO mini prints, digital media, or promotional portfolio content, etc.

• Personal Privacy Exception: If your custom video or artwork contains sensitive personal details (e.g., personal family photos, full names, or private personal messages), we will respect your privacy and omit or alter identifiable personal elements prior to any public commercial reproduction.

 

4. CUSTOM PROCESS, PAYMENTS, & DEPOSITS

• Upfront Payment / Deposit: Custom orders require full payment or a non-refundable deposit as specified at the time of your order before design or creative work begins.

• Order Finality: Once creative production, sketching, filming, audio recording, or painting has commenced on a custom project, the order cannot be canceled, refunded, or returned.

 

5. CUSTOMER-PROVIDED MATERIALS & COMPLIANCE

• Your Warranty: If you submit photographs, video clips, text, or ideas for your custom project, you guarantee that you own the materials or have full legal permission to use them.

• No Copyright Infringement: Love My Artist strictly respects copyright laws. We will not incorporate copyrighted or trademarked characters, logos, or media (e.g., Disney characters, corporate logos, protected songs) into custom artwork, videos, or audio.

• Indemnification: You agree to hold harmless and defend Love My Artist against any third-party claims arising from unauthorized materials you provide.

 

6. REVISIONS & APPROVALS

• Creative Discretion: By commissioning Love My Artist, you trust our unique artistic style and creative judgement.

• Proofing: Where proofing or preview drafts are included in your custom project quote (e.g., a sketch or video draft), feedback must be provided within 48 hours to avoid project delays. Major redesigns or changes outside the original project scope may incur additional creation fees.
